ملامح التجديد الفقهي عند الشيخ القرضاوي - دراسة فقهية

الملخص

This study aims to investigate the most important features of renovation in jurisprudence by Sheikh Qaradawi. The study depended on examining and analyzing the major features of the renovation of the Sheikh by evidenced to his sayings and fatwas in each topic of the study, foremost of which of the following have been proved: Reviving the spirit of conscientiousness “Ijtihad” in the nation and reject the tradition; realizing jurisprudence of purposes when applying judgments and facilitation upon Muslims; adopting the approach of moderation and rejection of extremism; realizing the jurisprudence of reality and complying  with the Quranic method in calling to Islam by presenting the priorities; freeing from sectarianism and taking into account the case of the targeted addressees; establishing a sense of tolerance and coexistence among humans and interacting with religious events and global issues. The researcher of this study adopted the descriptive method through the extrapolation of Sheikh’s fatwas and his juristic deductions  along with his evidence and citations in the issues of this study. The researcher also adopted the analytical approach based on the statement, interpretation and deduction at the end of each annex which is called  jurisprudence of the issue. The researcher has come up with several conclusions as it follows: The Sheikh’s approach of renovation depends on Ijtihad that is based on facilitation, relying on argument and evidence, and freeing from bigotry and tradition. The tendency of jurisprudential renovation of the Sheikh lies in the scientific and literary courage, and trend of the reform, and the realization of the jurisprudence purposes. The renovation of jurisprudence that the Sheikh aims to is the roots-based renovation, the renovation that does not void the text of its significance and content, and that never adapt the texts to comply with the whims and allegations. The renovation in style and content, and taking into account the conditions of people's time and place and adopting renovation as a method, has become a necessity of the modern times. In this study, the researcher has come up with certain recommendations. These recommendations are that the preachers, students and jurists should renovate their preaches and fatwas as required by the modern times in order to bring about the desired change for the communities and encourage the people to become more interactive and responsive to the Praying (Dawah) to Allah, The Almighty.
